1. Terms and conditions of cooperation with the international recruitment agency TK Recruitment (hereinafter – the Agency).

1.1. The present terms and conditions of cooperation with the Agency are deemed to be accepted by the unilateral manifestation of the will of the person who accepts them. By completing and returning the questionnaire on www.tk-recruitment.com, as well as using any of the services available on the site, you obtain registration as “the Candidate” or “the Client” (the free registration service is available only for candidates). Accordingly, you agree and warrant to abide by the rules and conditions of this agreement for as long as you continue to be on the Agency’s base and to use the Agency’s services. If you do not agree to the terms of this agreement, please do not use the Agency’s services and the services of the site.

1.2. This Agreement may be amended at any time by the Agency’s management at its discretion. Any changes will be posted on the website. Your continued use of the Agency’s services or site services after the posting of modifications to this Agreement will signify your acceptance of the modifications.

2. General provisions, definitions and list of Agency services:

2.1. The Agency is linked to the business sector that provides personalized recruitment and headhunting services, which consists of providing consultancy to Clients in order to find people for vacant positions, from which the ones with the best profile will be selected, in order to highlight them, consider them appropriate and evaluate them as potential candidates to be chosen as Potential Employee of the Client.

2.2. The Client wishes to engage and receive personalized Recruitment services from the Agency in accordance with the terms set forth in the Agreement.

2.3. The Agency is measured with defined standards and processes, using optimal databases, checking the references of each candidate, conducting psychometric tests to measure their technical, managerial or commercial competencies and using an interview model appropriate to the level of the position.

2.4. The Candidate is the user who freely and voluntarily registered on the Agency’s website and provided personal information about himself/herself to the Agency’s administration in order to obtain its services for free or for a fee. The Candidate who registers on the site must provide real and reliable information about himself/herself. You must be ready to conduct a personal interview or through existing means of communication such as Skype, Zoom etc. and also answer honestly and frankly to the questions contained in the questionnaire and to the psycho-technical tests.

2.5. Agency’s Client – is the status of the site user who registered on the Agency’s website, provided information about the company and vacant position, provided detailed information about the Personnel Application and who paid for the Agency’s services in accordance with the Contract with the Agency.

3. Site registration rules:

3.1. Registration on the Agency’s website is permitted only to those over 18 years of age. In case of non-compliance with the minimum age, your subscription will be cancelled. Identity shall be proven by showing official identification with photograph issued by the competent authorities of the country of origin or residence of the interested party.

3.3. Likewise, to obtain registration with the Agency and to use its services directly or on its website, you confirm and warrant that:

3.3.1. He has not been convicted of federal or common crimes in Mexico or any other country, nor has he been the subject of criminal investigations for any type of crime.

3.3.2. You confirm that you do not suffer from mental disorders and/or mental illnesses.

3.3.3. You confirm that you are not registered with the mental health and drug treatment clinics.

3.3.4. You are not prohibited from using this website or any similar site under your identity or any other identity.

3.3.5. You do not participate directly or indirectly (in any capacity) in a business that competes with the Agency’s services.

3.3.6. It does not pursue any benefit through the collection of contact details that will be provided to you as a result of your use of the website or our services. You also confirm that you are aware that the misuse of such information will be considered a violation of the conditions of the services provided by the Agency and, as a result, will result in the early termination of the relationship with the Agency.

4. Personal data:

4.1. The Agency does not make customer data available to the public. All information is stored exclusively in the Agency’s confidential database.

4.2. In compliance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals and the Regulations of the Federal Law for the Protection of Personal Data in Possession of Individuals (hereinafter the “Mexican Laws”), The Agency informs Clients and Candidates of the existence of a registry, database and/or file of a personal nature containing personal data such as names, surnames, e-mail addresses, mailing address, telephone number, identification number, photograph, CURP or any other information that allows identifying or making identifiable the owner of the data, e-mail addresses, mailing address, telephone number, identification number, photograph, CURP or any other information that allows identifying or making identifiable the owner of the data, and which are provided by the owner to The Agency in its CV or Register of companies, or by any other document provided by the Client or the Candidate or other means by the owner of such personal data (hereinafter “Personal Data”).

4.3. The Agency is in charge in terms of the Mexican Laws, is responsible for the use of the Personal Data of the Candidates and Clients, in which they will be used with the purpose of allowing the full provision of the services object of the Agency’s activity. Therefore, the Personal Data provided by the owners will be used by The Agency directly or through the other companies incorporated to the business organization of TK Recruitment, in the process of evaluation and selection of candidates and recruitment of personnel; therefore, the owner authorizes The Agency to make transfers and remissions of the Personal Data, in terms of the Mexican Laws. By providing the Personal Data, the Client and the Candidate authorize the processing, assignment, transfer, forwarding and/or disclosure, as the case may be, of such Personal Data in order to provide the job offers that best suit the objectives of the holders.

5. Non-discrimination:

5.1. The Agency as well as the Client and the Candidate are committed to promote equal opportunities between men and women, people with disabilities and senior citizens, non-discrimination in access to employment and prevent sexual harassment. By virtue of the foregoing, the parties undertake not to carry out discriminatory practices against any employee, applicant for employment, or any entity involved with the object of this contract, understanding discrimination as any distinction, exclusion or restriction that, based on ethnic or national origin, sex, age, disability, social or economic condition, health conditions, pregnancy, language, religion, opinions, sexual preferences, marital status or any other, has the effect of preventing or nullifying the recognition or exercise of the rights and real equality of opportunities of persons. Discrimination shall also be understood as xenophobia and anti-Semitism in any of its manifestations.

6. Confidentiality of information:

6.1. The Agency will guarantee the confidentiality of the information received from the Client and the Candidate and guarantees that the information will be used only for the purposes specified in the contract for the provision of recruitment services.

6.2. Contact information is communicated to the Agency’s Clients only upon acceptance and mutual interest of the parties. The contact information transmitted is coordinated with the Client or Candidate.

7. Termination of this Agreement and cooperation with the Agency:

7.1. The Agency may terminate any relationship with the Candidate at any time and for any reason for violation or non-compliance with these terms and conditions.

7.2. The Agency reserves the right to refuse to register the Candidate or Client, suspend or discontinue any type of relationship, without entering into further discussion without limiting the foregoing, if:

– the Client or the Candidate violates these Terms and Conditions;

– the Client or the Candidate represents another person;

– the Client or Candidate provides false information about himself/herself or others;

– the Agency in its sole discretion deems the Client’s or Candidate’s behavior unacceptable.

7.3. At the Client’s or Candidate’s express request, the Agency undertakes to remove the Client’s or Candidate’s data from the Agency’s database.

7.4. The cancellation of the Candidate’s profile is carried out by informing the Agency in writing about his/her wish to stop cooperating with the Agency, via e-mail.

8. Security :

8.1. The Agency takes all reasonable steps to carefully check that all Candidates wishing to register with the Agency are persons who meet the identity requirements and pass the security and reliability filters, in order to maintain a high level of service.

8.2. The Candidate agrees to pay any necessary indemnities for damages, losses, costs and expenses (including full legal costs of attorneys/clients) in connection with false information provided by the Candidate willfully and intentionally about himself/herself or about the purposes with the Client of contact provided to him/her.

9. Property rights:

9.1. The Agency has exclusive rights and ownership of the TK Recruitment brand, website with domain names, technologies, software, databases and any other information derived from the business.

10. Differences of the parties:

10.1. The parties agree that all possible disputes will always be resolved in the first instance by negotiation. If this is not possible, it may be submitted to commercial arbitration.

10.2. In case of any conflict situation or the receipt of a complaint / denunciation from a Client / Candidate / the Agency will be able to hand over the Client’s personal data to the police authorities.

10.3. In the event that the parties are unable to resolve the dispute through negotiation or arbitration, the dispute shall be submitted to the competent courts of Mexico City, in accordance with applicable local laws.

10.4. The Agency will not take part in any conflict that may arise between clients. Consequently, the customer agrees:

10.5. Not to interfere or attempt to interfere in any way with the Agency in any dispute or in the resolution of disputes arising between the Candidate as a result of the services provided by the Agency; and

10.5.1. Do not use the Agency’s services or website to attempt to resolve the dispute.

10.6. This agreement is effective from the moment it is registered on the site www.tk-recruitment.com.
